Terms & Conditions of Website Use

These Terms & Conditions govern use of www.empirepaintingwi.com, including its content, contact forms, project-photo uploads, downloadable resources and links to online scheduling tools. “Empire Painting,” “Empire,” “we,” “us” and “our” refer to the operator of this website. “You” and “your” refer to a visitor or user of the website.
Website use only. These terms do not establish or change a painting contract, project price, payment obligation, cancellation right or workmanship warranty. Those matters are addressed in separate project agreements and applicable law.
1. Acceptance & permitted use
Please review these terms before using the website. By using the website after receiving reasonable notice of these terms, you agree to them to the extent an enforceable agreement is formed under applicable law. If you do not agree, please stop using the website; you may contact Empire by phone with questions about our services.
You may browse the website, review our work, access resources and submit legitimate inquiries for yourself or a business you are authorized to represent. If you submit a request on someone else’s behalf, you must have permission to provide their information. Do not misrepresent your identity, affiliation or authority.
2. Prohibited activities
You may not use the website to:
- Submit fraudulent inquiries, impersonate another person, or send unsolicited advertising or spam.
- Upload malicious code, harmful files, unlawful material or content that infringes another person’s intellectual property or privacy rights.
- Attempt unauthorized access to accounts, administrative tools, servers, systems or nonpublic information.
- Disrupt the website, overload its infrastructure, bypass security measures or interfere with another visitor’s use.
- Harvest personal information, scrape protected content for unauthorized commercial reuse, or use automated tools in a way that violates law or materially burdens the website.
- Use Empire’s name, branding or content to create a misleading association, endorsement or competing imitation of this website.
This section does not prohibit lawful search-engine indexing, accessibility tools, uses permitted by law or honest customer reviews.
3. Ownership of website materials
Original website text, photographs, graphics, logos, designs, videos and other protected materials are owned by Empire or used with permission from their owners. Browsing the website does not transfer ownership or grant a commercial license.
You may view and print reasonable portions for personal use or to evaluate Empire’s services, provided you retain applicable ownership notices. Except as permitted by law or with prior written permission, you may not republish, sell, license, commercially distribute, modify or reuse protected materials. Third-party names and trademarks belong to their respective owners.
You may link to publicly available pages if the link is accurate and does not suggest an endorsement that does not exist. Do not frame or present this website in a way that disguises its source or misleads visitors. For permission requests or a concern about material on this website, contact us with the relevant page URL and details.
4. Information, photographs & online estimates
Service descriptions, blog articles, guides, photographs, examples and planning tools provide general information. They are not a property inspection, a binding quote or a guarantee that every property will achieve the same result. Screens, lighting, surface conditions and photography can affect the appearance of colors and finishes.
Any preliminary pricing or planning output is subject to the assumptions displayed with it and Empire’s review of the actual project. Submitting a form, uploading photographs or booking an estimate appointment does not by itself authorize paid painting work or create a service contract. Any project-specific commitments must be confirmed through Empire’s separate project process.
We make reasonable efforts to keep website information current, but content may contain errors or become outdated. We may correct errors and update information. Corrections do not retroactively alter an accepted agreement or remove rights provided by law. Promotions are subject to their stated eligibility requirements and terms; contact us if an offer is unclear.
5. Forms, files & project photographs
Provide accurate information and upload only materials you own or have permission to share. Avoid including unrelated personal information, payment-card numbers, passwords, government identification numbers or other unnecessary sensitive details in general website forms.
You retain ownership of your submissions. By submitting content, you grant Empire a nonexclusive, royalty-free permission to receive, store, reproduce and share it with service providers assisting us only as reasonably necessary to evaluate your request, prepare an estimate, communicate with you and administer the services you request, consistent with our Privacy Policy and applicable law.
This permission is limited to those purposes. Uploading a photograph does not, by itself, authorize publication in advertising, transfer ownership of the photograph or waive anyone’s privacy rights. Public marketing use requires separate permission or another lawful basis.
Empire may reject or remove unlawful, malicious, irrelevant or technically unsuitable submissions. File-size and file-type limits may apply. Keep a copy of materials you submit; the website is not a file-storage or backup service. If you do not receive an expected response or confirmation, contact the office to verify receipt.
6. Privacy & communications
Our Privacy Policy explains how personal information is handled. These website terms do not replace that policy or create broader permission to collect, disclose or use personal information.
When you request information or an appointment, Empire may respond about that request using the contact details you provide, subject to applicable consent requirements. Submitting an inquiry is not blanket consent to unrelated marketing or automated marketing calls and texts. Any consent required for a particular communication will be obtained separately; marketing consent is not a condition of purchasing services.
You may opt out of optional marketing communications by following the instructions in the message or contacting the office. Necessary responses to your inquiry and communications about an existing project are distinct from optional marketing. Please use a contact method you are authorized to provide and tell us if your details change.
7. Scheduling tools & external websites
This website may link to or embed third-party scheduling services, maps, review platforms, media and other tools. Those providers operate their own services, and their terms and privacy policies may apply when you use them. A link does not mean Empire endorses every statement on the linked website.
Empire does not control independent third-party websites, their availability or changes they make. Review their policies before providing information. Scheduling availability can change; confirm appointment details through the booking confirmation or our office. An estimate appointment does not reserve a painting crew or a project start date.
8. Availability, security & restricted access
We may maintain, modify, suspend or discontinue website features. We do not guarantee uninterrupted availability, compatibility with every device, or that the website will always be free of errors or harmful components. Use appropriate device security and take care when downloading files.
Empire may restrict access or reject submissions reasonably necessary to address misuse, security concerns, unlawful activity or operational problems. A restriction on website access does not cancel an existing painting agreement or remove an obligation we otherwise owe you. Contact the office if a technical or accessibility issue prevents you from using the website.
9. Website disclaimers
To the extent permitted by applicable law, the website and its general informational content are provided “as is” and “as available.” Empire disclaims implied warranties concerning the website, including merchantability, fitness for a particular purpose and noninfringement, to the extent those warranties may lawfully be disclaimed.
These disclaimers concern the website and its informational resources. They do not disclaim an express promise in an accepted project agreement, change a written workmanship warranty, excuse misleading advertising or limit a right that cannot legally be excluded.
10. Limitation of website-related liability
To the extent permitted by applicable law, Empire is not liable for indirect, incidental, special or consequential damages, including lost profits, business interruption or loss of data, arising from use of or inability to use this website or reliance on its general informational resources.
This limitation applies only where legally enforceable. It does not exclude liability for fraud, willful misconduct, gross negligence, personal injury or other liability that applicable law does not allow to be excluded. It does not limit Empire’s liability for painting services, property damage arising from those services, or obligations under an accepted project agreement or written warranty. Where a limitation is not permitted, the applicable legal protections remain in effect.
11. Questions, concerns & legal rights
Please contact Empire with the page URL, a description of the issue and any relevant details so we can investigate a website concern. Do not include passwords or other sensitive credentials.
These terms do not prohibit honest reviews, complaints to regulators or the exercise of consumer rights. They do not require mandatory arbitration, waive a jury trial or shorten a statutory claim period.
12. Governing law & general provisions
Wisconsin law governs these website terms to the extent permitted by applicable law, while preserving any mandatory protections that otherwise apply. These terms do not impose an exclusive court location. If a provision is found unenforceable, the remaining provisions continue to apply to the extent legally permitted. A failure to enforce a provision on one occasion does not automatically waive the right to enforce it later.
These terms address website use only. Separate agreements govern painting services and any other transaction for which specific terms are provided. In the event of a conflict, applicable law and the relevant accepted agreement govern that transaction.
13. Updates to these terms
We may revise these terms as the website, our practices or applicable requirements change. The effective date at the top identifies the current version. Revisions apply prospectively. We will provide any additional notice or obtain any consent required for a change to be effective. Posting an update does not retroactively change a project agreement or waive an existing claim.
